    BILL 51, THE PLANNING AND CONSERVATION LAW STATUTE AMENDMENT ACT

    Legislation to reform Ontario's planning system and promote sustainable development has been passed by the Ontario legislature. The Planning and Conservation Land Statute Law Amendment Act, 2006, is intended to enable development of more compact, energy efficient and transit-friendly communities. The Act include reforms to Ontario Municipal Board processes, which emphasize local planning and continue to provide the board with a role to ensure well-planned growth.

    The new legislation establishes additional requirements for information and consultation at the front-end of the planning process and will provide more opportunity for public involvement. Through land-use planning tools, municipalities will be able to consider architectural features, new technologies and sustainable design in the development of new communities.

    Bill 51 is part of the government's plan to manage growth in a strategic manner. The planning and OMB reforms are intended to work together with the greenbelt and growth plan.

    New rental legislation passed by the government will take effect January 31, 2007. The Residental Tenancies Act is intended to implement a fairer rental housing system that benefits good tenants and good landlords. The new legislation will eliminate the current eviction process and ensure fairer rent increases for tenants, help landlords protect their investment and encourage a healthy investment climate. The Ontario Rental Housing Tribunal will become the Landlord and Tenant Board.

    LEGISLATURE PASSES CLEAN WATER ACT, BILL 43

    The Ontario government passed the Clean Water Act, Bill 43, on October 18th, 2006. The act delivers on 12 of Justice O'Connor's recommendations resulting from the judicial inquiry into the Walkerton tragedy. The Act provides for communities to protect their municipal drinking water supplies through developing collaborative, locally-driven, science based protection plans. Communities will identify potential risks to local water sources and take action to reduce or eliminate these risks.

    OHBA has expressed concern to the province the manicipalities will be required to undertake an additional mandate that is unfunded, particularly one in which municipalities will have limited input into decision-making and no approval authority. OHBA forsees that municipalities will likely increase development application approval fees or user fees as measures to finance these additional responsibilities.

    The Ontario Building and Renovation Forum is right around the corner, January 11 and 12, 2007. The Forum is the most informative and relevant industry training event in Canada.
